Terms of Service

3.1 Account Creation

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@hireready.co.nz if you suspect any unauthorised use of your account.

3.3 Account Types

The Platform offers separate account types for Candidates, Employers, and Recruiters. Certain features, obligations, and fees apply differently depending on your account type. You must use the account type that accurately reflects your intended use of the Platform.

3.4 One Account Per User

Each individual or organisation may maintain only one active account per account type. Hire Ready reserves the right to merge or terminate duplicate accounts.

4.1 Licence

Subject to these Terms, Hire Ready grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose.

4.2 Permitted Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

• Post false, misleading, or fraudulent Job Listings or candidate profiles;
• Use the Platform to discriminate against any person on the basis of protected characteristics under applicable law, including the Human Rights Act 1993 (NZ) or the Sex Discrimination Act 1984 (AU);
• Scrape, crawl, or otherwise extract data from the Platform without our prior written consent;
• Reverse engineer, decompile, or disassemble any portion of the Platform;
• Use automated tools, bots, or scripts to access the Platform without authorisation;
• Transmit spam, unsolicited messages, or any form of mass communication to other Users;
• Circumvent any access controls, security measures, or subscription limitations; or
• Use the Platform for any purpose other than genuine recruitment and employment-related activities.

5.1 Candidate Profiles

Candidates may create a profile on the Platform containing information about their skills, experience, qualifications, and employment history. You are solely responsible for ensuring your profile is accurate, truthful, and up to date.

5.2 Job Applications

By applying for a Job Listing, you consent to Hire Ready sharing your profile and application materials with the relevant Employer or Recruiter. Hire Ready does not guarantee that you will receive a response or be considered for any position.

5.3 No Employment Guarantee

Hire Ready is a marketplace and is not a party to any employment relationship between a Candidate and an Employer or Recruiter. We make no representations about the suitability, accuracy, or legitimacy of any Job Listing.

6.1 Job Listings

Employers may post Job Listings on the Platform subject to these Terms and any applicable Subscription plan. All Job Listings must:

• Relate to genuine, available employment or contract opportunities;
• Accurately describe the role, responsibilities, remuneration (where required by law), and requirements;
• Comply with all applicable employment laws, including the Employment Relations Act 2000 (NZ) and the Fair Work Act 2009 (AU); and
• Not contain discriminatory language or criteria that are unlawful under applicable anti-discrimination legislation.

6.2 Employer Responsibilities

Employers are solely responsible for their hiring decisions, employment agreements, and compliance with all applicable employment, privacy, and workplace laws. Hire Ready is not liable for any hiring decision made by an Employer.

6.3 Job Listing Removal

Hire Ready reserves the right to remove any Job Listing that we reasonably believe violates these Terms, applicable law, or our community standards, without prior notice.

7.1 Recruiter Obligations

Recruiters represent and warrant that they:

• Hold any licences or registrations required to operate as a recruiter under applicable law;
• Have the authority of the relevant Employer before submitting Candidates on their behalf;
• Comply with the Privacy Act 2020 (NZ) or the Privacy Act 1988 (AU) when handling Candidate data; and
• Do not charge Candidates a fee for placement or referral unless permitted by law.

7.2 Recruiter Accounts

Recruiter accounts may be subject to additional verification requirements. Hire Ready reserves the right to suspend or terminate a Recruiter account if we reasonably believe the account is being used improperly or in breach of these Terms.

8.1 Your Responsibility

You are solely responsible for all User Content you submit to the Platform. You represent and warrant that your User Content does not:

• Infringe the intellectual property rights of any third party;
• Contain false, defamatory, or misleading information;
• Contain personal information of a third party without their consent; or
• Violate any applicable law or regulation.

8.2 Licence to Hire Ready

By submitting User Content to the Platform, you grant Hire Ready a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, and display your User Content to the extent necessary to operate and improve the Platform.

8.3 Content Moderation

Hire Ready does not routinely review User Content but reserves the right to remove or disable any User Content that we reasonably believe violates these Terms or applicable law.

10.1 Free and Paid Tiers

The Platform may offer both free and paid Subscription plans. Features available under each plan are set out on our Pricing page, which may be updated from time to time.

10.2 Payment

Paid Subscriptions are billed in advance on a monthly or annual basis. All prices are in New Zealand Dollars (NZD) or Australian Dollars (AUD) as applicable, and are exclusive of applicable taxes including GST unless stated otherwise.

10.3 Cancellation and Refunds

You may cancel your Subscription at any time. Upon cancellation, you will retain access to paid features until the end of the current billing period. Hire Ready does not provide refunds for unused portions of a Subscription period, except where required by applicable consumer protection law, including the Consumer Guarantees Act 1993 (NZ) or the Australian Consumer Law.

10.4 Price Changes

Hire Ready may change Subscription pricing at any time. We will provide at least 30 days' notice of any price increase. Continued use of the Platform after a price change takes effect constitutes your acceptance of the new pricing.

16.1 Term

These Terms apply from the date you first access the Platform and continue until terminated.

16.2 Termination by You

You may close your account at any time by following the account deletion process in your account settings.

16.3 Termination by Hire Ready

Hire Ready may suspend or terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe that you have breached these Terms or that your continued access poses a risk to other Users or to the Platform.

16.4 Effect of Termination

Upon termination, your right to access the Platform ceases. Clauses that by their nature should survive termination — including clauses relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

18.1 Governing Law

These Terms are governed by the laws of New Zealand. If you are accessing the Platform from Australia, mandatory provisions of Australian consumer law will also apply to the extent required by law.

18.2 Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution by good-faith negotiation. If unresolved within 30 days, either party may refer the matter to mediation before a mutually agreed mediator. If mediation is unsuccessful, the dispute may be referred to the courts of New Zealand.

19.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific services, constitute the entire agreement between you and Hire Ready with respect to your use of the Platform.

19.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19.3 No Waiver

Hire Ready's failure to enforce any provision of these Terms does not constitute a waiver of its right to do so in the future.

19.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. Hire Ready may assign these Terms in connection with a merger, acquisition, or sale of assets.

19.5 Force Majeure

Hire Ready will not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure is caused by circumstances beyond our reasonable control.
